Man shot by Bannock deputy arrested

BANNOCK COUNTY, Idaho -

A man shot by a Bannock County deputy on the Fort Hall Indian Reservation has been arrested on a warrant.

Kevin Toane, 33, is being charged with eluding a police officer in a motor vehicle, as well as assault and battery with an enhancement of using a deadly weapon. Both charges are felonies. Bond has been set at $50,000.

Toane was shot in November after Toane tried ramming a deputy's car at the end of a late-night chase that Bannock County Sheriff Lorin Nielsen had said began when a deputy spotted a vehicle suspected in the hit-and-run.

Toane was taken to Portneuf Medical Center and later flown to University of Utah Medical Center.

The Shoshone-Bannock Tribes have said excessive force may have been used against Toane, and they want a transparent investigation into the case.
